This page explains how HailShopWare designs its tools to reduce unlawful or unwanted messaging, and what shops must do. It is operational guidance, not legal advice.
1. Who obtains consent?
When a shop enters a customer and sends an estimate, status update, or marketing message, the shop obtained consent — not HailShopWare. Shops warrant they have all required permissions before uploading contacts or sending through the Platform (see Terms and emailer activation warranties).
2. Why we care about country / region
Spam and privacy rules differ by location. Examples:
- United States — CAN-SPAM: accurate headers, non-deceptive subjects, identify commercial content, valid physical postal address, working unsubscribe honored within 10 business days.
- Canada — CASL: generally requires express (or implied in narrow cases) consent before commercial electronic messages, plus identification and unsubscribe.
- EU / UK — GDPR & ePrivacy: marketing emails generally need affirmative consent; stricter transparency and lawful-basis rules apply.
When a request hits our servers, we may read country codes supplied by the hosting/CDN layer. We store that code on accounts or leads when available. If region is unknown, platform marketing blasts are blocked by default.
3. Platform rules
- Required “contact through [Shop Name]” acknowledgment on forms
- Separate optional status vs marketing opt-ins
- Owner/admin must activate emailer warranties before blasting
- Marketing sends require marketing opt-in + acknowledgment
- Commercial emails must carry shop postal address and unsubscribe link
4. Transactional vs marketing
Job status updates that a customer requested, signature requests, password resets, and similar relationship messages are treated differently from promotional blasts. Do not disguise advertising as transactional content.
5. Custom domains (professional sending)
Shops can connect their own domain in Settings → Emailer so customer mail sends from addresses like service@joesdentrepair.com (SPF / DKIM via Resend). Prefer a subdomain so existing website email is not disrupted. Until verified, messages may send from platform infrastructure with your shop as Reply-To.
6. Unsubscribe
Recipients can use Unsubscribe or contact the shop. Shops must stop marketing to unsubscribed addresses.
7. Liability allocation
Shops are the sender of their customer marketing when they promote their own services. HailShopWare provides tools and enforcement rails; shops indemnify the platform for misuse (see Terms and DPA).
